Terms of Use
Rules for using GovGPT.AI web services and local-only mobile apps.
These Terms of Use govern access to and use of GovGPT.AI, including the hosted website, account portal, chat interface, memory features, team management tools, documentation features, local-only mobile apps, and related services provided by GovSoft, LLC.
1. Agreement to These Terms
By accessing or using GovGPT.AI, you agree to these Terms of Use. If you use the service on behalf of a company, vendor organization, agency, association, or other entity, you represent that you have authority to bind that entity, and "you" includes both you and that entity.
If you have a separate written agreement, order form, statement of work, data processing agreement, or master services agreement with GovSoft, that agreement controls if it conflicts with these Terms.
GovGPT.AI is intended for business use by authorized EasyBMV vendors, their teams, and related organizations. It is not intended for consumer use or for children. These Terms apply to both the hosted web service and the mobile app, except where a section specifically describes one version.
2. Hosted Web Service
The hosted web service provides an AI-powered assistant designed to help users work with vendor operations, documentation, procedures, team workflows, and related business tasks. Features may include web chat, retrieval of reference materials, account settings, organization management, user memory, and data usage transparency.
We may update, suspend, limit, replace, or discontinue any feature at any time, including to improve security, comply with law, address third-party provider changes, manage capacity, or improve the product.
3. Mobile App: Local-Only AI
The GovGPT.AI mobile app is designed to run local on-device AI models. GovSoft does not receive, sync, back up, review, or process your mobile prompts, chats, documents, local memories, model inputs, model outputs, embeddings, or in-app usage activity.
Because local mobile content stays on your device, GovSoft cannot recover it, export it, delete it remotely, review it for support, or restore it if your device is lost, damaged, reset, backed up incorrectly, or erased. You are responsible for device access controls, device security, local backups, and deciding whether to export or share local content outside the app.
The mobile app may receive app updates, local model updates, operating system services, or app-store services. App marketplaces, device operating systems, enterprise device management tools, backup services, carriers, and third-party apps you use to share content are not controlled by GovSoft and may operate under separate terms and privacy policies.
4. Accounts, Eligibility, and Authority
- You must be at least 18 years old and authorized by your organization to use GovGPT.AI.
- You are responsible for keeping your login credentials secure and for all activity under your account.
- You must provide accurate account information and keep it current.
- Vendor administrators are responsible for inviting, removing, and managing users within their organization.
- You must promptly notify GovSoft of suspected unauthorized access, credential compromise, or security incidents involving the service.
The local-only mobile app may operate without a GovSoft account. If a future mobile feature requires sign-in or connection to a hosted service, that connected feature will be governed by the hosted web service terms and privacy disclosures.
5. Acceptable Use
You may use GovGPT.AI only for lawful, authorized business purposes. You may not:
- Use the service in violation of law, regulation, contract, agency rule, or your organization's policies.
- Submit data you are not authorized to use, disclose, process, or transmit.
- Submit sensitive citizen records, motor vehicle records, driver's license numbers, Social Security numbers, payment card data, health information, biometric information, criminal justice information, or confidential government records unless your written agreement with GovSoft expressly permits that processing.
- Use AI outputs as the sole basis for legal, regulatory, eligibility, licensing, employment, financial, safety-critical, or government benefit decisions.
- Attempt to bypass access controls, probe security, reverse engineer the service, scrape the platform, overload systems, introduce malware, or interfere with other users.
- Use the service to generate deceptive, fraudulent, infringing, discriminatory, harassing, defamatory, or unlawful content.
- Use the service to create or facilitate child sexual abuse material, sexual content involving minors, non-consensual sexual content, non-consensual intimate imagery, malicious deepfakes, targeted harassment, credible threats, or exploitation.
- Use the service to create malware, credential theft, phishing, evasion, unauthorized surveillance, or instructions that facilitate cyber abuse.
- Use the service to forge official documents, impersonate a person or agency, deceive voters or public officials, misrepresent eligibility, or enable dishonest behavior.
- Represent AI-generated content as official agency guidance unless an authorized agency or contract permits that representation.
- Use the service to develop a competing model, dataset, or service except where expressly permitted by a written agreement.
For local-only mobile use, GovSoft cannot see private on-device activity. Enforcement of these rules may occur through product safeguards, app updates, app-store action, support reports, connected-service activity, or lawful process, rather than through monitoring local app content.
6. Customer Content and Data
"Customer Content" means prompts, chats, files, documents, memories, feedback, corrections, organization data, and other content submitted to or generated through GovGPT.AI by or for your organization.
As between you and GovSoft, you retain ownership of Customer Content. You grant GovSoft a limited license to host, process, transmit, display, reproduce, and use Customer Content as needed to provide, secure, support, maintain, and improve GovGPT.AI, comply with law, and perform our contractual obligations.
You are responsible for Customer Content, including its accuracy, legality, permissions, confidentiality status, and suitability for use with AI systems. You must maintain appropriate backups of content that your organization needs to preserve outside the service.
For the mobile app, local prompts, chats, files, memories, model inputs, model outputs, and embeddings remain on your device and are not licensed to GovSoft for hosted processing unless you intentionally send them to GovSoft outside the app, connect the app to a hosted feature, or agree to a future feature that clearly changes the local-only design.
7. AI Outputs, Human Review, and No Official Advice
GovGPT.AI uses artificial intelligence and may generate outputs based on user prompts, retrieved documentation, memory settings, and other available context. AI outputs can be inaccurate, incomplete, outdated, biased, or unsuitable for a particular use.
You are responsible for reviewing and validating outputs before relying on them. You should verify any procedure, legal requirement, compliance answer, or operational instruction against authoritative sources, including statutes, regulations, agency materials, contracts, vendor manuals, and your organization's policies.
GovGPT.AI does not provide legal advice, tax advice, financial advice, professional compliance opinions, official agency determinations, or final government guidance. The service is a decision-support and productivity tool, not a substitute for trained professionals or official sources.
Unless expressly stated in a written agreement, GovGPT.AI is not an official system of record, not a government agency website, and not a replacement for any required government filing, notice, approval, or verification process.
Mobile app outputs are generated locally on your device. Local models may be smaller, older, less capable, or less current than hosted models. The mobile app may not have access to updated laws, rules, procedures, agency materials, vendor manuals, organization policies, or web-connected retrieval unless those materials are already stored on your device or added through an authorized update.
You should not rely on GovGPT.AI, including the mobile app, as a lawyer, compliance officer, regulator, physician, accountant, financial adviser, procurement official, or government decision-maker. Use qualified professionals and official sources for decisions requiring professional judgment.
8. Memory and Personalization
GovGPT.AI may include memory features that store preferences, recurring context, user corrections, location-specific information, and workflow patterns to improve future responses. Memory should be reviewed, corrected, disabled, or deleted when it is inaccurate, outdated, or no longer authorized.
Organization administrators may control or restrict memory features for their teams. GovSoft may remove, quarantine, or disable memory data that appears unlawful, unsafe, unauthorized, or inconsistent with these Terms.
In the local-only mobile app, memory and personalization data remains on the device. GovSoft cannot centrally moderate, correct, delete, synchronize, audit, or restore local mobile memories.
9. Privacy and Security
Our Privacy Policy explains how we collect, use, disclose, retain, and protect information. By using GovGPT.AI, you acknowledge the Privacy Policy.
You are responsible for using GovGPT.AI in a way that complies with your organization's privacy, security, retention, records, confidentiality, and data classification requirements.
For the mobile app, you are also responsible for device-level protections such as passcodes, biometric locks, operating system updates, encryption settings, backup settings, app permissions, mobile-device-management rules, and secure disposal or transfer of devices.
10. Third-Party Services, App Stores, and Materials
GovGPT.AI may rely on third-party hosting, AI model, database, analytics, support, communications, and security providers. Third-party services may be subject to their own terms, policies, availability, rate limits, retention rules, and security controls.
The service may reference or link to third-party websites, public materials, government materials, agency resources, vendor documentation, or other external content. GovSoft does not control and is not responsible for third-party content unless expressly stated in a written agreement.
If you download the mobile app through Apple App Store, Google Play, or another app marketplace, that marketplace's terms, license rules, payment rules, refund rules, family sharing rules, device rules, and privacy practices may also apply. Apple, Google, and other app marketplaces are not responsible for GovSoft support, local app data recovery, or AI outputs except to the extent required by their own terms or applicable law.
Mobile apps are licensed, not sold. If GovSoft provides a custom app-store EULA, that EULA may supplement these Terms and must satisfy applicable marketplace requirements. If no custom Apple EULA is provided for an iOS app, Apple's standard Licensed Application End User License Agreement may apply as required by Apple.
11. Intellectual Property
GovSoft and its licensors own GovGPT.AI, including software, interfaces, designs, workflows, models, prompts, documentation, branding, templates, and other proprietary materials, except for Customer Content and third-party materials.
Subject to these Terms and any applicable order form, GovSoft grants you a limited, non-exclusive, non-transferable, revocable right to access and use GovGPT.AI for your authorized business purposes. No rights are granted except as expressly stated.
If you submit feedback, suggestions, or ideas, GovSoft may use them without restriction or obligation to you, unless a written agreement says otherwise.
12. Fees and Orders
Fees, payment terms, usage limits, service levels, implementation obligations, renewal terms, and taxes may be set out in a separate order form, subscription agreement, statement of work, or other written agreement. If no paid order applies, GovSoft may limit or discontinue access at any time.
13. Confidentiality
You may receive confidential information through GovGPT.AI, including non-public software, workflows, documentation, security information, pricing, roadmaps, and vendor or agency materials. You must protect confidential information using reasonable care and use it only for authorized purposes.
GovSoft will protect Customer Content according to the Privacy Policy, these Terms, and any applicable written agreement.
14. Suspension and Termination
We may suspend or terminate access if we reasonably believe that you or your organization violated these Terms, created security risk, infringed rights, submitted unauthorized data, failed to pay amounts due, or used the service in a way that could harm GovSoft, users, vendors, agencies, or third parties.
You may stop using the service at any time. Termination does not affect obligations that should reasonably survive, including confidentiality, payment, ownership, disclaimers, liability limits, indemnity, and dispute terms.
Termination of hosted service access does not necessarily remove local mobile content from your device. You must delete the app or use device or app controls to remove local content.
15. Disclaimers and Limitation of Liability
To the fullest extent permitted by law, GovGPT.AI is provided "as is" and "as available." GovSoft disclaims warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, uninterrupted operation, and error-free performance.
To the fullest extent permitted by law, GovSoft will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of data, business interruption, procurement loss, reputational harm, or reliance on AI outputs.
To the fullest extent permitted by law, GovSoft's total liability for claims relating to the service will not exceed the amounts paid to GovSoft for the service during the twelve months before the event giving rise to the claim, or one hundred dollars if no paid order applies. Some jurisdictions do not allow certain limitations, so some limitations may not apply.
GovSoft is not responsible for loss, disclosure, corruption, or unavailability of local mobile content caused by device loss, theft, malware, jailbreak or rooting, operating system behavior, backup settings, shared devices, user export, third-party apps, app marketplace services, or failure to maintain local backups.
Updates may change local models, safety behavior, reference materials, storage formats, operating system compatibility, and available features. Some updates may be required for security, marketplace compliance, or continued operation.
16. Indemnity
To the fullest extent permitted by law, you will defend, indemnify, and hold harmless GovSoft and its affiliates, personnel, contractors, and suppliers from claims, losses, liabilities, damages, costs, and expenses arising from your Customer Content, misuse of the service, violation of these Terms, violation of law, or infringement or misappropriation of third-party rights.
17. Government, Vendor, and Public-Sector Use
GovGPT.AI may support organizations that work with government or regulated industries, but GovSoft is not a government agency unless expressly stated in a signed agreement. Use of the service does not create government approval, agency endorsement, procurement eligibility, licensure, compliance certification, or legal authorization.
You are responsible for complying with public records, procurement, retention, accessibility, confidentiality, cybersecurity, CJIS, DPPA, motor vehicle, and other requirements that apply to your organization or data.
18. Governing Law and Disputes
Unless a written agreement says otherwise, these Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. Subject to any mandatory law or contract requirement, the state and federal courts located in Ohio will have exclusive jurisdiction over disputes relating to these Terms or GovGPT.AI.
Before filing a claim, the parties will attempt in good faith to resolve the dispute through business escalation. Either party may seek injunctive or equitable relief to protect confidential information, intellectual property, security, or system integrity.
19. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and provide additional notice where required. Continued use of GovGPT.AI after updated Terms become effective means you accept the updated Terms.
